WhatsApp & Third-Party Connectivity Disclaimer

Kontaible is an independent product of Kontaible SRL. We are not affiliated with, endorsed by, sponsored by, certified by, or operated by WhatsApp LLC, Meta Platforms, Inc., or Intuit/QuickBooks. "WhatsApp," "Meta," "QuickBooks," and other names are trademarks of their respective owners, used here only to describe technical interoperability.

2. How WhatsApp Connectivity Works — and the Risk

2.1 Unofficial Connection Method

Kontaible may connect to WhatsApp using unofficial, web-based methods (including the open-source Baileys library) that emulate WhatsApp Web. These methods are not authorized by WhatsApp/Meta and may violate the WhatsApp Terms of Service and Business Messaging Policy.

These outcomes are entirely outside our control. They can occur even with normal, good-faith use. Risk increases with high message volume, bulk or cold outreach, recipient reports, and patterns WhatsApp's systems flag as abusive.

3. You Connect at Your Own Risk

By linking a WhatsApp number to Kontaible, you acknowledge and agree that:

• You connect entirely at your own risk and are solely responsible for your number and account.
• We do not guarantee that WhatsApp connectivity will work, remain available, be uninterrupted, or avoid bans.
• We are not liable for any suspension or ban of your number, loss of messages or contacts, business interruption, or any resulting damages (see Terms §11–§12).
• You should use a number you can afford to lose, maintain independent backups of critical contacts and records, and not rely on Kontaible's WhatsApp connectivity as your sole channel for time-critical or legally significant communications.

4. Your Compliance Obligations

By connecting WhatsApp, you agree to:

• Comply with WhatsApp's own Terms of Service and Business Messaging Policy, and with the Kontaible Acceptable Use Policy;
• Only message recipients for whom you have a lawful basis and consent under Dominican Republic Ley 172-13, and honor all opt-out requests immediately;
• Not use the connectivity for spam, purchased contact lists, or mass unsolicited outreach; and
• Use only numbers and accounts you are legally authorized to use.

You are solely responsible for all messages sent through your account and for any third-party claims arising from them (see Terms §13 — Indemnification).

5. Official WhatsApp Alternative

WhatsApp offers an official WhatsApp Business Platform (Cloud API) through Meta and approved Business Solution Providers. This is the compliant path for business messaging at scale but requires Meta approval and has its own fees and policies. We recommend evaluating the official API for production or mission-critical use cases.

If and when Kontaible supports the official WhatsApp Business API, this section will be updated.

6. Other Third-Party Integrations

Integrations with QuickBooks, accounting and invoicing tools, payment processors, AI providers, email services, and cloud storage are operated by third parties under their own terms and conditions. We are not responsible for their availability, accuracy, changes to their services, or any actions they take. Your use of those integrations is at your own risk and subject to each provider's terms.

7. Changes to This Disclaimer

We may update this Disclaimer as connectivity methods or third-party policies change. Material changes will be notified per the Terms of Service notification procedures.
