Acceptable Use Policy

This Acceptable Use Policy is part of the Terms of Service and applies to everyone who uses Kontaible. Breaching it may lead to suspension or termination and can cause your WhatsApp number or account to be banned by WhatsApp/Meta (see WhatsApp Disclaimer).

1. You Must Not

1.1 Send spam or unlawful messages. No unsolicited bulk messaging, no messaging recipients without a lawful basis/consent, and no messaging recipients who have opted out. Honor opt-out/STOP requests promptly.

1.2 Violate data-protection or consumer law, including Ley 172-13 (personal data) and Ley 358-05 (Pro Consumidor), or message minors unlawfully.

1.3 Send prohibited content: anything illegal, fraudulent, deceptive, defamatory, harassing, hateful, violent, sexually exploitative, or that infringes intellectual-property or privacy rights.

1.4 Engage in financial crime: money laundering, tax evasion facilitation, or using the Service to create false accounting or fiscal records.

1.5 Abuse the system: attempt to breach security, bypass tenant isolation, access other tenants' data, reverse engineer (except as permitted by law), scrape, overload, or interfere with the Service or its infrastructure.

1.6 Misuse WhatsApp connectivity — e.g., mass cold-outreach, purchased lists, or automated spam patterns that get numbers banned.

1.7 Misuse AI features to generate unlawful content, impersonate, or mislead recipients about who they are dealing with.

1.8 Resell or provide the Service to third parties except as expressly permitted by your plan.

2. You Must

• Have a lawful basis and required consents before importing contacts and messaging them
• Identify yourself/your firm truthfully in communications
• Keep your account, seats, and integrations secure
• Use only WhatsApp numbers and accounts you are authorized to use
• Verify automated output (OCR, AI, exports) before relying on it for any client, tax, or financial purpose

3. Messaging & Anti-Spam Specifics

• Maintain proof of the legal basis to contact each recipient
• Provide a clear opt-out and honor it
• Do not send at volumes or patterns designed to evade WhatsApp's anti-abuse systems
• You are responsible for the content of automated/scheduled campaigns

4. Enforcement

We may investigate suspected violations and may remove content, throttle, suspend, or terminate access, with or without notice depending on severity and legal requirements. We may report unlawful activity to authorities. We are not liable for actions taken in good faith to enforce this AUP.
