This policy has two layers: (1) If you are our customer or account user — we are the controller of your account and billing data. (2) If you are a client of one of our customers — for that data, the CPA firm is the controller and Kontaible is only the processor. Contact that firm to exercise your rights over their records.

5. Sharing & Subprocessors

We share data only with:

Subprocessors listed at kontaible.com/legal/subprocessors (infrastructure, payments, AI, email)
Legal authorities when required by Dominican law or court order
Successors in a merger or acquisition (with notice to you)

We do not sell your personal data.

6. International Transfers

Our infrastructure (Railway, Cloudflare R2, Turso) is primarily in the US. By using the Service you acknowledge cross-border transfer. We apply contractual protections with subprocessors consistent with Ley 172-13 requirements.

7. Retention

Account data: duration of your subscription + 30 days after termination, then deleted
Customer Data: as described in the DPA — 30 days post-termination then deleted unless you export first
Billing records: 10 years (Dominican tax law)
Logs: 90 days rolling

8. Security

We use encryption in transit (TLS), encrypted storage, access controls, and audit logging. In the event of a personal data breach affecting your rights, we will notify you within 72 hours of becoming aware, as required under Ley 172-13.

9. Customer's Clients' Data (Processor Role)

When you upload your clients' data (contacts, documents, WhatsApp conversations), Kontaible acts as a data processor under your instructions. The Data Processing Agreement (DPA) governs that relationship. You remain the data controller and are responsible for your clients' rights.

10. Your Rights (Ley 172-13)

As a data subject, you have the right to:

Access — request a copy of data we hold about you
Rectification — correct inaccurate data
Erasure — request deletion (subject to legal retention obligations)
Portability — receive your data in a machine-readable format
Objection — object to processing based on legitimate interest
Withdraw consent — for consent-based processing (won't affect prior processing)

Submit requests to info@kontaible.com. We respond within 30 days. You may also lodge a complaint with the Dominican data protection authority.

12. Children

The Service is not directed at individuals under 18. If we become aware we have collected data from a minor without consent we will delete it promptly.

13. Changes

We will notify you of material changes by email or in-app notice before they take effect. The "Effective date" at the top shows the latest version.
